The protection of your personal data is a priority for Azul Anacrónico, Lda. Therefore, under Regulation No. 2016/679 of the European Parliament and of the Council of 27 April 2016 (General Data Protection Regulation), we are pleased to communicate our Privacy Policy, which will inform you of the new rules applicable to the processing of your personal data, your rights, and how you can easily manage your consents directly.

The rules set out in this Privacy Policy complement the provisions on the protection and processing of personal data contained in the "General Conditions of the www.azulanacronico.pt store", which govern the offer of our products and are duly published on the website and accepted by the Customer.

This Privacy Policy applies exclusively to the collection and processing of personal data carried out by Azul Anacrónico, Lda

 

 

 

Who are we?

Your data will be processed by Azul Anacrónico, Lda, sociedade por quotas com sede social em Praceta Carlos Pereira Callixto, 1, 3º esq, Alfragide, 2610-032 Amadora, Portugal, matriculada sob o número de identificação fiscal 517225484, (doravante designada por Azul Anacrónico).

A Azul Anacrónico is responsible for the processing of your personal data, within the meaning of the General Data Protection Regulation (hereinafter referred to as GDPR).

 

 

 

What is personal data?

Personal data is any information, of any nature and regardless of the medium, including sound and image, relating to an identified or identifiable natural person.

A person is considered identifiable if they can be identified directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, online identifiers or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person.

 

 

 

What type of personal data do we collect?

In the course of its activity, Azul Anacrónico will collect and process the personal data necessary for the sale and delivery of goods purchased by the Customer, in particular the name, address, telephone number, email address, payment details, Internet Protocol (IP) address, and tax identification number.

 

 

 

Why do we process your information?

Your personal data may be collected and processed by Azul Anacrónico for the following purposes:

a)     cumprimento de obrigações legais a que a Azul Anacrónico is subject, notably invoicing for goods purchased;

b)     cumprimento de obrigações contratuais da Azul Anacrónico 's contractual obligations, especially for the purposes of the logistics process of delivering the goods purchased;

c)      efeitos de gestão de contactos e reclamações;

d)     efeitos de contacto, no âmbito de estratégias de marketing da Azul Anacrónico's marketing strategies, with commercial information and communications, namely through the sending of newsletters.

 

Failure to provide personal data for the purposes set out in points a) and b) implies a breach, by Azul Anacrónico, of contractual and legal obligations imposed on it, a situation that constitutes grounds for Azul Anacrónico, not to conclude the purchase and sale contract, without any right to compensation or indemnification.

Why do we process your information?

The processing of your personal data will be carried out based on the execution of the purchase and sale contract of products concluded with Azul Anacrónico, , and in strict compliance with legal obligations imposed on Azul Anacrónico, , namely in matters of tax legislation (see points b) and c) of paragraph 1 of Article 6 of the GDPR).

For the purpose set out in point c) above, Azul Anacrónico will process personal data based on a legitimate interest pursued by itself, as well as by the Client (see point f) of paragraph 1 of Article 6 of the GDPR).

Furthermore, the lawfulness of processing the personal data collected for the purpose set out in point d) above is based on the consent given by the Client to Azul Anacrónico for the respective processing (see point a) of paragraph 1 of Article 6 of the GDPR).

 

 

 

How long do we keep your information?

Without prejudice to any legal, regulatory or judicial determination to the contrary, the personal data collected will only be kept for the minimum period necessary for the purposes that motivated its collection or subsequent processing.

The most relevant retention periods that we have defined for the purposes of using your personal data are as follows:

i. Transaction management – legal period of 10 years;

ii. Customer management in loyalty program – 3 years

iii. Marketing – 2 years (plus the current year) since the last interaction;

iv. Website or platform user management – 1 year (plus the current year) after the last access;

v. Home deliveries – 2 years;

vi. Guarantees and after-sales support – 2 years or equal to the warranty period if longer;

vii. Registration and proof of transactions for remote contracts – 6 months after the contract's validity period;

viii. Service management – 2 years since the last service.

 

 

 

To whom may we transmit your personal data?

Occasionally, Azul Anacrónico may have to share some of your personal data with other recipients, including:

a)     Organizações e/ou empresas afiliadas à Azul Anacrónico, , provided they respect an equivalent policy regarding the protection of personal data;

b)     Entidades Públicas às quais a Azul Anacrónico is legally obliged to provide information, namely the DGCI – General Directorate of Taxes;

c)      Subcontratantes que prestam determinados serviços relacionados com os seus dados pessoais sob a cobertura de um subcontrato e com o único objetivo de prestarem assistência técnica à Azul Anacrónico, , including but not limited to website hosting providers, email and marketing service providers;

d)     As autoridades competentes às quais a Azul Anacrónico, is legally obliged to disclose information in the course of legal proceedings, or to detect technical and/or security problems, such as competent judicial entities or supervisory authorities.

 

 

 

Is your data transferred to countries outside the European Union?

Your personal data, collected by Azul Anacrónico, , will not, as a rule, be transferred to any entity established outside the territory of the European Union.

Exceptionally and under certain conditions, Azul Anacrónico may transfer your personal data to countries outside the territory of the European Union, in accordance with applicable legislation, for the purposes of data hosting or storage, technical subcontracting of processing, backup and recovery of hosted data, and service development.

A Azul Anacrónico ensures that it will not transfer your personal data to countries that do not guarantee an adequate level of protection, in accordance with the provisions of the GDPR.

 

 

 

What are your rights?

Under the provisions of the GDPR, you may request, at any time:

 

a) access to your personal data: you have the right to obtain confirmation as to whether or not personal data concerning you is being processed and, if so, the right to access your personal data and the information provided for in the GDPR.

 

b) rectification of your personal data: you have the right to obtain from Azul Anacrónico, , without undue delay, the rectification of inaccurate personal data concerning you.

 

c) o apagamento dos seus dados pessoais: you have the right to obtain from Azul Anacrónicowithout undue delay, the erasure of your personal data, and Azul Anacrónico must erase your personal data without undue delay when, in particular, one of the following grounds applies: 1) the personal data are no longer necessary for the purposes for which they were collected or processed; 2) the data subject withdraws consent on which the processing is based (where based on consent) and there is no other legal ground for the processing; 3) the data subject objects to the processing and there are no overriding legitimate grounds for the processing;

 

d) a limitação do tratamento realizado: you have the right to obtain from Azul Anacrónico the restriction of processing if one of the following applies: 1) you contest the accuracy of the personal data, for a period enabling Azul Anacrónico to verify the accuracy of the personal data; 2) the processing is unlawful and the data subject opposes the erasure of the personal data and requests, instead, the restriction of its use; 3) a Azul Anacrónico no longer needs the personal data for processing purposes, but this data is required by the data subject for the establishment, exercise or defense of legal claims; 4) if the data subject has objected to the processing, until it is verified that the legitimate grounds of Azul Anacrónico override those of the data subject.

 

e) o direito de se opor ao tratamento: when processing is carried out for the purposes of the legitimate interests pursued by Azul Anacrónico, , the data subject has the right to object at any time, on grounds relating to his or her particular situation, to the processing of personal data concerning him or her. f) o direito à portabilidade dos dados: : under the terms and conditions defined by law, you have the right to receive the personal data concerning you that you have provided to Azul Anacrónico, in a structured, commonly used and machine-readable format, and the right to transmit this data to another controller without hindrance from the controller to whom the personal data were provided, if: 1) The processing is based on consent or contract; and 2) The processing is carried out by automated means.

 

If the requests submitted are manifestly unfounded or excessive, in particular due to their repetitive nature, Azul Anacrónico may (i) require payment of a reasonable fee taking into account the administrative costs of providing the information or communications, or of taking the requested measures, or (ii) refuse to act on your request.

Regarding personal data whose processing by Azul Anacrónico is legitimized by the consent it has given, you have the right to withdraw your consent. The exercise of this right will not compromise the lawfulness of the processing carried out based on the previously given consent, nor the subsequent processing of the same data based on another legal basis, such as compliance with a contractual or legal obligation to which Azul Anacrónico is subject.

You also have the right to lodge a complaint with the National Data Protection Commission.

 

 

 

How can you object to receiving marketing communications?

 

Within the scope of the consent you have given, Azul Anacrónico may, in particular, promote new products or services by telephone, email, mail, SMS, MMS, or any other electronic communications service.

If you do not wish your personal data to be processed, you may object, at any time, to its use for marketing purposes, sending informational communications, or inclusion in lists or informational services.
